These terms and conditions apply to the Robert Michael Diamonds website located at www.robertmichaeldiamonds.com and its subsidiaries and affiliates, including Robert Michael Diamonds’ sites around the world (collectively the “Site”) and other websites that expressly incorporate these Conditions ("Conditions"). In some instances, a particular Robert Michael Diamonds product purchased through the Site may be subject to additional policies, guidelines, terms, and/or agreements ("Terms"). In the event that such Terms are inconsistent with these Conditions, the Terms shall govern. BY VISITING AND/OR USING THIS SITE IN ANY WAY, SUCH AS BROWSING PRODUCTS OR PLACING AN ORDER, YOU AGREE TO THESE TERMS AND CONDITIONS. Please read these Conditions carefully. The Site and all content and other materials, including, without limitation, text, icons, graphics, logos, images, designs, pictures, selection, coordination, "look and feel", information, data, sound files, software, and other files are the proprietary property of Robert Michael Diamonds or its affiliates, licensors, or users and are protected by United States and international copyright, trademark, patent, and trade dress laws. You are authorized to use this material only for personal, non-commercial purposes. You may download, print, and store copies for your own personal use. No license is granted to use any trademark or service mark displayed on the Site without written permission. Robert Michael Diamonds will enforce its rights aggressively.

Robert Michael Diamonds, the Robert Michael Diamonds logos, and any product or service name or slogan contained on our Site are trademarks of Robert Michael Diamonds and/or its licensors, and may not be copied, imitated, or used without prior written permission. All other trademarks mentioned are the property of their respective owners.

Use of the Site

You are granted a personal, limited, non-sublicensable license to access and use the Site and electronically copy and print Site materials for personal, non-commercial use only. This license does not include: (a) resale or commercial use; (b) data mining, robots, scraping, or similar methods; (c) derivative uses or modifications; (d) framing or embedding of the Site; or (e) interference with Site operations. Any unauthorized use terminates this license and may violate laws.

Information on Our Site

Robert Michael Diamonds strives to provide accurate, current information. However, errors (including typographical or system errors) may occur. We reserve the right to correct any errors or inaccuracies at any time without notice. Prices and availability are subject to change without notice. If a product is listed at an incorrect price, Robert Michael Diamonds may cancel the order. Images may not reflect actual size. Lab-grown diamonds are graded within industry tolerances (carat weight ±0.05, measurement ±0.25mm). Color and clarity grades may be expressed as averages or minimums.

Robert Michael Diamonds retains the full rights to all jewelry designs, whether custom or standard, and may market or sell such designs.

Multiple purchases for the purpose of comparison and return are not permitted.

Important: Robert Michael Diamonds sells lab-grown diamonds only. We do not sell natural diamonds.

Your Account and Order

You are responsible for maintaining confidentiality of your account and password, and for restricting access to your account. You accept responsibility for all activities under your account. If you are under 18, you may use the Site only with the involvement of a parent or guardian. Robert Michael Diamonds reserves the right to refuse service, terminate accounts, or cancel orders at its discretion.

If a chargeback is filed, Robert Michael Diamonds may recover costs and cancel promotions, discounts, or shipping benefits associated with the order.

Diamond Certificates

Customers purchasing lab-grown diamonds with grading reports will receive the original certificate with their order. Please note that certificates are expensive to replace and must be returned with the diamond for any refund or exchange. A $250 replacement fee will apply if the certificate is not returned.

Passage of Title and Risk of Loss

Title to and risk of loss of products purchased from Robert Michael Diamonds transfers to the customer at the time the order is handed over to UPS (or the designated shipping carrier). From that point onward, customers assume responsibility for the products, including for any damage, loss, or theft that occurs during shipment.

Order Approval and Cancellation

Receipt of an order confirmation does not signify acceptance. Orders are binding only when processed and approved at Robert Michael Diamonds’ headquarters. We reserve the right to cancel any order for any reason. The customer’s sole remedy is refund of funds collected.

Privacy

Please review our Privacy Policy, which governs your visit to this Site. Robert Michael Diamonds may disclose information to comply with lawful requests or to protect our rights, customers, or operations.

Repeat Infringer Policy

In accordance with the DMCA and other laws, Robert Michael Diamonds may terminate access for repeat infringers of intellectual property rights.

Advertisements and Promotions

Our Site may include third-party promotions. Dealings with third parties are solely between you and those providers. Robert Michael Diamonds is not responsible for any losses or damages resulting from such dealings.
